The Case Manager is responsible for representing the company or its affiliates in courtroom proceedings, depositions, and mediations (in-person or telephonically) regarding loans in default or as required by state statutes or judicial order. Ensures all mediations, hearings, trials and depositions activities are carried out to minimize company cost and /or liability. Perform all duties in accordance with company policies and procedures and all state and federal regulations. The target pay range for this position is $56,400.00 to $ 104,600.00 annually.
What you’ll do:
Make appearances as a corporate representative in court hearings, depositions and mediations regarding foreclosure matters in person and telephonically.
Reviews and analyzes foreclosure, bankruptcy and other litigated cases set for mediations, depositions, or trial to ensure documentary evidence exists to support entitlement to judgment in court; detects and escalates issues affecting entitlement to judgment to management for review.
Function as the subject matter expert on servicing businesses, including but not limited to default and loss mitigation operations.
Negotiates with parties on behalf of CMS pursuant to company guidelines, investor guidelines, or other delegated authority.
Recommends solutions to cases where legal impairments to foreclose (i.e. evidentiary issues, servicing errors, or law firm errors) exist.
Reviews, evaluates, and recommends approval requests for additional fees and fee waivers, with low to moderate loss severity.
Maintains departmental information system support files.
Evaluates and recommends adjustments to department processes to maximize efficiency and effectiveness and improve departmental performance.
Performs other duties and special projects as assigned or other duties as needed by Supervisor, Manger or above in Loss Mitigation and Default Departments.
High percentage of day or overnight travel is required up to 75% depending on business needs and appearance needs of CMS.
Strong working knowledge of loss mitigation products and processes
Strong working knowledge of general civil litigation, foreclosure and bankruptcy processes s required.
Proficient with Microsoft Office Word, Outlook, and Excel
Familiarity with default mortgage servicing data and communication systems such as Sagent, Tempo, OnBase, etc.
Ability to multitask, identify and respond effectively to litigation issues.
A strong drive to accomplish goals, coupled with a high sense of urgency.
Strong negotiation skills.
Ability to build strong rapport with all level of people to foster interdepartmental cooperation.
Excellent written and verbal communication skills to relay complex testimony to CMS foreclosure counsel, judges, mediators, opposing counsel and borrowers.
Able to testify competently under oath for hearings, trials and mediations often in highly stressful situations, truthfully and effectively on loan level and corporate operations details.
Ability to read and understand mortgage documents, reports, and attorney correspondence.
Ability to maintain composure, professionalism, and credibility in high stress workplaces, such as a courtroom.
Ability to interact with Management and to provide or gather information.
Ability to make decisions that have significant impact on the department’s credibility, operations, and services.
Ability to formulate complex and comprehensive materials such as legal documents, authoritative reports, official publications of major scope and impact, etc., and/or to make formal presentations
Ability to organize and prioritize work schedule to maximize efficiencies and appearance coverage
What you’ll need:
Bachelor’s degree or equivalent work experience
Five (5) plus years’ working in a mortgage servicing environment, with the most recent 3 years’ experience in foreclosure, bankruptcy, or loss mitigation fields.
Paralegal certificate or JD preferred but not required.
Experience working with mortgage servicing, loss mitigation, bankruptcy, foreclosure, and general civil litigation policies, statutes, and procedures.
